1. Acceptance
By accessing or using Fit Tracker you agree to be bound by these terms. If you do not agree, do not use the service. Fit Tracker may update these terms; continued use after an update constitutes acceptance.
2. Accounts
You must provide accurate information when registering and are responsible for activity under your account. Fit Tracker may suspend or terminate accounts that violate these terms.
3. Acceptable Use
You must not abuse Fit Tracker, attempt to bypass security controls, scrape or harvest data without permission, or use the service to send spam, malware, or unlawful content.
4. Payment and Billing
Paid plans are billed in advance per the price displayed at checkout. Refunds follow Fit Tracker's refund policy communicated at point of sale.
5. Intellectual Property
Fit Tracker retains all rights to Fit Tracker's software, designs, and brand. Customer data you submit remains yours; you grant Fit Tracker a limited licence to process it to operate the service.
6. Warranty Disclaimer
Fit Tracker is provided "as is" without warranties of any kind.Fit Tracker disclaims all implied warranties including merchantability and fitness for a particular purpose.
7. Limitation of Liability
To the maximum extent permitted by law, Fit Tracker's aggregate liability for any claim arising from these terms or Fit Tracker is limited to the amount you paid Fit Tracker in the twelve months preceding the claim.
8. Termination
You may cancel your account at any time. Fit Tracker may terminate or suspend access for breach of these terms. Sections that by their nature should survive termination (intellectual property, liability, governing law) survive.
